Terms of Service

These Terms of Service ("Terms") govern your access to and use of MOQ Pools ("MOQ Pools", "we", "us", or "our"). By accessing or using the platform, you agree to be bound by these Terms. If you do not agree, do not use the Service.

These Terms should be read together with our Refund Policy, Shipping Policy, Payment Protection, and Privacy Policy.

• You must be at least 18 years old to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate, current, and complete information and to keep it updated.
• MOQ Pools may suspend or terminate accounts that violate these Terms.

MOQ Pools is a demand-pooling and order coordination platform.

Products are supplied by third-party manufacturers or sellers.

When you join a group order ("pool"):

• You indicate intent to purchase a selected quantity if the pool proceeds
• Your payment method may be authorized or temporarily held, but funds are not immediately released to any supplier
• A pool proceeds only if it reaches its stated MOQ within the specified time
• If the MOQ is not reached, the pool expires and your authorization is released or refunded.

• Payments are processed by third-party providers such as Stripe and supported payment networks
• MOQ Pools does not store full payment card details

Payment Flow

• Before MOQ: payment may be authorized or held
• After MOQ: payment may be captured and released in stages, not all at once
• Funds may be withheld or execution paused if conditions are not met

• Prices, MOQs, shipping methods, and timelines are disclosed on pool listings
• Prices may be updated before a pool proceeds
• If material terms change after MOQ is reached, MOQ Pools may cancel the pool and issue refunds

• Delivery timelines are estimates, not guarantees
• Shipping methods may include direct or consolidated shipments
• Customs, duties, VAT, and local taxes are the buyer's responsibility unless explicitly stated otherwise

Refund eligibility and processes are governed by our Refund Policy.

In general:

• Pools that do not proceed are fully refunded
• After execution begins, refunds depend on the issue (e.g. loss, damage, non-shipment)
• Buyer remorse after execution begins is not refundable
• Payment disputes and chargebacks are handled in accordance with payment network rules.

You agree not to:

• engage in fraudulent activity
• abuse the platform or suppliers
• manipulate pools or create multiple accounts to do so

You are responsible for providing accurate shipping and contact information.

MOQ Pools reserves the right to:

• modify, suspend, or discontinue any part of the Service
• update listings, pools, or platform features
• suspend or terminate accounts for misuse or violations

To the maximum extent permitted by law:

• MOQ Pools is not liable for indirect, incidental, or consequential damages, including lost profits, business interruption, or customs charges
• Our total liability for any claim is limited to the amount you paid for the affected order

Nothing in these Terms limits liability where prohibited by law.

• All platform content, trademarks, and software are owned by MOQ Pools or its licensors
• Users retain ownership of content they submit (e.g. reviews), but grant MOQ Pools a non-exclusive license to display and use it for platform purposes

12. Governing Law & Jurisdiction

These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles.

Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Singapore.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted with an updated "Last updated" date. Continued use of the Service constitutes acceptance of the revised Terms.
